Welcome to Munchkins AI LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our platform, text messaging services, and artificial intelligence-driven recruitment features (collectively, the “Services”).

By clicking the link in our text message, interacting with our AI agent, or using our Services, you (“User,” “Candidate,” or “you”) agree to be bound by these Terms. If you do not agree, please do not use the Services or interact with the AI agent.

1. Description of Services

Munchkins AI provides an AI-powered recruitment platform. Our services include sending text message invitations to job candidates, hosting an interactive platform where candidates engage with an artificial intelligence conversational agent (“AI Agent”), and collecting interview data to assist employers in the hiring process.

2. SMS and Text Messaging Consent

By providing your phone number to a prospective employer or directly to our platform, you expressly consent to receive recurring automated text messages (including SMS and MMS) from us regarding job opportunities, interview scheduling, and reminders.

• Privacy: We do not share your mobile information or opt-in data with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
• Consent: Consent to receive text messages is not a condition of purchase or employment.
• Opt-Out: You can cancel the SMS service at any time. Just text “STOP” to the number we messaged you from. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed.
• Help: For help, reply “HELP” or contact support@munchkins.ai.
• Carrier Charges: Message and data rates may apply for any messages sent to you from us and to us from you.

3. Interaction with the AI Agent

Our Services utilize advanced artificial intelligence, machine learning, and natural language processing to conduct preliminary interviews and screenings.

• Nature of the AI: You acknowledge and agree that you are interacting with an automated AI Agent, not a human being.
• No Guarantee of Employment: The AI Agent collects information to assist employers. The AI Agent does not make final hiring decisions, and interaction with the AI does not guarantee employment or advancement in the hiring process.
• Prohibited Conduct: You agree not to attempt to trick, manipulate, “jailbreak,” or feed malicious code/prompts into the AI Agent. You will not use profane, abusive, or discriminatory language during your interaction.

4. Data Privacy, Collection, and Use

Your privacy is incredibly important to us. Your interaction with the AI Agent will be recorded, transcribed, and analyzed.

• Data Processed: We collect your contact information, voice recordings (if applicable), text chat transcripts, and resume data.
• Employer Sharing: You grant us permission to share all data gathered during the AI interview with the specific employer(s) associated with your application.
• Privacy Policy: All data collection is governed strictly by our Privacy Policy, which complies with relevant data protection laws (e.g., CCPA, GDPR, where applicable).

5. Intellectual Property

All content, software, AI models, algorithms, text, and branding used in the Services are the exclusive property of Munchkins AI or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for its intended recruitment purpose.

6. Limitation of Liability & Disclaimers

“As Is” Basis: The Services and the AI Agent are provided on an “as is” and “as available” basis. We make no warranties regarding the accuracy of the AI’s transcriptions or assessments.

Limitation: To the maximum extent permitted by law, Munchkins AI shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of job opportunities, lost data, or emotional distress arising out of your use of the AI Agent.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of Connecticut, USA. Any disputes arising from these Terms or the use of the Services will be resolved through binding arbitration in Fairfield County, Connecticut, rather than in court.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any major changes by updating the “Last Updated” date at the top of this document.
